Compliance Deadline for Federal Contractors Approaching

On January 20, 2009, President Obama signed Executive Order 13496, requiring federal contractors to post notices to employees informing them of their rights to bargain collectively under federal law. The U.S. Department of Labor (DOL) has issued final regulations implementing the executive order. The regulations require federal contractors to post a notice available from the DOL that sets out various rights employees have under the National Labor Relations Act. The notice must be posted conspicuously in places where the federal contractor posts other notices to employees about their rights and terms and conditions of employment.

 A copy of the notice, which must be 11 x 17 inches in size, is available from DOL’s website by clicking here. Employers whose printers are not able to print on 11 x 17 inch paper may print from an alternative site on two 8 ½ x 11 inch sheets that must be taped together (click here). Federal contractors must begin posting the notice on June 21, 2010.

 There are exemptions from the notice posting requirement. The most notable is that contracts below the simplified acquisition threshold (currently $100,000 for contracts and $10,000 for subcontracts) are not covered. In addition, contracts from solicitations prior to the effective date of the regulations (June 21, 2010) are not covered.
